Comprehensive Changes Made to the Private Hospitals Regulation
With the new regulation enacted by the Ministry of Health, private hospitals holding TÜSKA accreditation are granted exemption from audits, while flexibility has been provided in physical conditions and service procurement.
The Regulation on Amending the Private Hospitals Regulation, prepared by the Ministry of Health, entered into force after being published in the Official Gazette dated August 29, 2026. With this regulation, audit processes, physical standards, and service procurements in the healthcare sector have been reshaped.
New Regulation Published in the Official Gazette
The new regulation prepared by the Ministry of Health officially entered into force upon publication in the Official Gazette dated August 29, 2026, and numbered 33355. This comprehensive amendment concerns a broad area ranging from audit processes to physical standards of private hospitals.
Audit Exemption for TÜSKA Certified Hospitals
A new era has begun for hospitals certified by the Turkish Health Services Quality and Accreditation Institute. Hospitals in the platinum or gold categories will be exempt from routine audits for 3 years, those in the silver category for 2 years, and those in the bronze category for 1 year.
This exemption covers only routine audits and will not prevent extraordinary audits to be conducted in case of complaints or notifications.
Tolerance and Exemptions in Physical Conditions
The physical measurement deviation tolerance regarding private hospital buildings has been increased from 2 percent to 5 percent. Additionally, hospitals that obtained licenses before January 30, 2025, have been exempted from the new physical condition requirements.
Flexibility in Imaging and Laboratory Services
In line with the provisions of the new regulation, X-ray and medical laboratory services are allowed to be met through on-site service procurement. Staffing support may be provided by the Ministry of Health to hospitals lacking device or laboratory specialist positions.
Special Permission Opportunity for Private Practice Physicians
With the regulation closely concerning private practice physicians, medical interventions that cannot be performed in contracted hospitals are allowed to be carried out in another private hospital with the case-based special permission of provincial health directorates.
