New Regulations on Public-Private Partnership Method Take Effect
With a new decree issued by the government, a hybrid contract type has been introduced in public-private partnership projects and various financial regulations have been established.
The government has officially issued Decree No. 377/2026/ND-CP, which includes amendments detailing certain provisions of the Law on Investment under the Public-Private Partnership Method.
Scope of the Decree and Amendments
The newly issued Decree No. 377/2026/ND-CP provides a comprehensive update by amending articles of various previously enacted decrees related to science, technology, digital transformation, and financial management.
New Hybrid Contract Type
A hybrid contract has been added to the system as a new type of public-private partnership contract, and this model is envisioned to be applied particularly in projects within the fields of science, technology development, innovation, and digital transformation.
Financial Regulations and Guarantees
Within the framework of the regulations made, procedures regarding the calculation of hiring costs for foreign consultants have been added, and a contract performance guarantee requirement has been introduced for information technology projects that do not require payment.
Effective Date
The provisions of this new decree, which includes innovations and additions regarding the public-private partnership method, officially entered into force as of October 1, 2026.
