13th Judicial Package Draft: Alimony, Divorce and Rent Regulations
The 13th Judicial Package draft plans to introduce a limit on alimony duration, identity verification on social media, and accelerate lawsuit durations.
The preparation-stage 13th Judicial Package draft includes important changes regarding alimony duration limitations, appeal conditions for divorce cases, identity verification on social media, and rent and eviction lawsuit durations.
Following the Constitutional Court's annulment of the phrase regarding indefinite alimony in Article 175 of the Turkish Civil Code, work is underway on a new model. The draft plans for the alimony duration to be at least 3 years and not exceed half of the time elapsed from the beginning of the marriage until the date the divorce case was filed. Additionally, the creditor's age, health status, and the economic conditions of the parties will also be evaluated within the judge's discretion.
In order for divorce cases to be finalized in a short time, it is foreseen that if the decision of the first instance court is found to be substantively appropriate by the regional court of appeal, it will not be possible to resort to the Court of Cassation (appeal stage). Separating property division disputes from divorce processes and reducing the statute of limitations to 5 years are also among the options.
In order to prevent crimes such as illegal betting and drugs on social media platforms, transitioning to an e-Government connection or identity verification system is being evaluated. In line with the goal of accelerating judicial processes, it is aimed to conclude rent determination lawsuits within 9 months and eviction lawsuits within 18 months.
