Draft Law on Investment Funds Decided to be Liquidated on Parliament's Agenda
Following a break in the Turkish Red Crescent Draft Law at the General Assembly of the Parliament, the regulation regarding investment funds planned for liquidation has been moved forward. The new proposal defines the liquidation processes under the supervision of the CMB and the principles for interim payments to be made to investors.
The schedule for the Draft Law on Certain Investment Funds Decided to be Liquidated, which is being discussed in the General Assembly of the Parliament, has been moved forward. The regulation reorganizes the management of funds decided to be liquidated by the CMB, investor payments, and liability principles.
According to the proposal, the liquidation process of the funds will be carried out under the supervision of the Capital Markets Board (CMB). For the funds determined by the Board, it is envisaged that an interim payment of up to 1 million Turkish Liras will be made to investors with a net investment amount below 1 million TL, and up to 1 million TL to those with 1 million TL or more.
Within the scope of the regulation, no payments will be made to individuals identified as being connected to the funds whose liquidation was decided by the decisions dated September 17, 2026. Furthermore, seizure orders may be applied in investigations related to the funds in accordance with the Criminal Procedure Code.
The CMB will determine the damage and loss amounts and notify the Savings Deposit Insurance Fund (TMSF). The amounts accumulated in the recovery account will be transferred to shareholders through the Investor Compensation Center (YTM) after deducting expenses. The portfolio management companies that are the founders or managers of the fund will be primarily held responsible for the damage and loss.
