Suspects in fund investigation want to return ill-gotten gains

In the fund investigation conducted by the Istanbul Chief Public Prosecutor's Office, the number of suspects has risen to 217 and the number of detainees to 85. With the actions being evaluated within the scope of organized crime, 90% of the suspects stated that they wanted to return their ill-gotten gains.

Current Status of the Investigation and Number of Detainees

In the fund investigation conducted by the Istanbul Chief Public Prosecutor's Office, the number of suspects rose to 217 and the number of detainees to 85. The number of individuals subjected to judicial control provisions became 98.

It is stated that the number of detentions may increase further with new dispatches to be received from relevant institutions such as MASAK and the CMB.

Scope of Organized Crime and Remorse Requests

The Chief Public Prosecutor's Office evaluating the actions within the scope of organized crime changed the course of the investigation. Realizing that they could face heavy prison sentences, the suspects changed their tune.

Ninety percent of the suspects undergoing judicial proceedings stated during their prosecutor's interrogations that they wanted to return the ill-gotten gains they had acquired.

Capital Markets Law and Return Conditions

The suspects requested that the provisions in the 3rd paragraph of Article 107 of the Capital Markets Law also be applied in their favor.

According to the relevant article, the sentence to be given for monies paid during the investigation phase is reduced by half.

Financial Data and Overseas Transfer Reviews

The prosecutor's office sent a writ to MASAK, requesting the financial data belonging to the sub-companies of the holding companies mentioned in the investigation.

Money and crypto asset transfers carried out by managers and their first-degree relatives since 2024 have been taken under review.

High Amount Transferred to TMSF Account

Fatma Betül Sayan Kaya and her husband İlyas Kaya sent the portion of their fund investments outside of the principal to TMSF's voluntary refund account.

This refund transaction totaling 1 billion 860 million liras was carried out with the permission of the Istanbul Chief Public Prosecutor's Office.
