China's First Health Security Law Adopted
China has approved its first dedicated law aimed at protecting citizens' rights and improving the health security system.
The Standing Committee of the National People's Congress of China has adopted the first dedicated Health Security Law aimed at protecting citizens' rights and strengthening the health security system. Set to take effect on January 1, 2027, the new law consists of 7 chapters and 56 articles.
Adoption and Scope of the Law
Approved on August 28, 2026, at the 24th Session of the Standing Committee of the National People's Congress, the Health Security Law holds the distinction of being the country's first dedicated statute in this field.
Comprising seven chapters and fifty-six articles, the regulation comprehensively addresses the health security system, fund management, services, supervision, and legal responsibilities.
Multi-Layered Health System
The law provides for the establishment and development of a multi-tiered national health security system centered around basic health insurance.
Clarifying insurance policies for workers as well as urban and rural residents, the law also encourages the development of commercial insurance and charitable activities.
Regulation of Services and Fund Security
The law mandates the standardization of public health security services in both urban and rural areas and the improvement of direct payment mechanisms.
While stating that inspections will be increased to protect the health security fund, heavy fines and service suspension penalties are prescribed for those who misappropriate the fund.
Effective Date and Framework of Reforms
Officially entering into force on January 1, 2027, the law aims to integrate the gains of health insurance system reforms into a legal framework.
The regulation also guarantees at the state level the establishment and development of a long-term care insurance system.
