New Regulations for Legal Violations in Science and Digital Transformation Processes
The 16th National Assembly has enacted a new resolution providing exemption from criminal liability for legal violations in the fields of science and technology.
Resolution No. 37/2026/QH16, adopted by the 16th National Assembly, introduces exemptions from criminal liability under certain conditions for innovative individuals who act in the public interest and follow regulations during science, technology, innovation, and digital transformation processes.
Risk Management and Exemption
Individuals who cause damage due to risks encountered in the application of science and technology, while complying with all procedures and measures, are exempt from criminal liability.
Exemption is evaluated on the condition that individuals do not engage in corruption during emergency situations where existing regulations are contradictory.
Protection of Innovative Individuals
The resolution aims to encourage and protect proactive and creative individuals working for the public interest.
Those who act in the best interests of the community and without personal gain are distinguished from risk-takers.
Conditions Required for Exemption
Not all violations fall under a general exemption scope; specific conditions are required on a case-by-case basis.
The absence of corruption, the presence of public interest, the realization of benefits, and the remediation of damages are among the core conditions.
Prevention of Misuse
Special mechanisms do not mean relaxing discipline; rather, they strictly address the misuse of policies.
The aim is to prevent abuses committed for the purpose of covering up violations or causing waste.
Implementation Period and Scope
Taking effect on September 1, 2026, the new resolution will remain in force for a period of three years.
Information dissemination campaigns are being conducted to ensure that relevant agencies and organizations correctly understand the scope of the new policy.
