Under Government Decree No. 188/2025/ND-CP, the rights of individuals with five or more years of continuous health insurance participation and the conditions for calculating this duration have been officially established.

Legal Regulation and Scope of the Decree

In accordance with Article 18 of Government Decree No. 188/2025/ND-CP, the benefit levels for individuals with five or more years of continuous health insurance participation have been detailed.

Copayment Threshold and Financial Conditions

To fully benefit from this assistance, the required copayment threshold has been officially established at more than 15.18 million VND per year.

Conditions Recognized as Continuous Participation Periods

Any interruption within the health insurance coverage of up to ninety days is considered a continuous period, preventing the loss of rights.

For individuals sent abroad for work, study, or employment purposes, or for their family members, the time spent abroad is counted towards the participation period.

Rules for Workers and Overseas Personnel

For workers going abroad under contract, their previous periods remain valid provided they resume insurance within thirty days after returning to the country.

Unemployment and Other Special Situations

For workers applying for unemployment benefits, previous participation periods are included, excluding the time between the termination of the contract and the application.

Periods for Military and Public Officials

In cases of retirement, military service, or resignation, the time spent in the military, police, and cryptographic organizations is counted as a continuous participation period.

Coverage Rate for Treatment Expenses

Special rights arise when the medical expenses within the year for those who have participated in health insurance for five consecutive years exceed six times the reference level.

One hundred percent of the medical examination and treatment expenses are covered by the fund, provided that conditions such as following proper procedures or emergency situations are met.
