The Constitutional Court has rejected the request to cancel the regulation requiring a spouse to be a permanent staff member for relocation requests based on spousal status for contract-based health personnel. The decision, published in the Official Gazette dated October 22, 2026, was not reached unanimously.
The Constitutional Court decision, which closely concerns the relocation applications of contract-based health workers due to family unity excuses, has been published in the Official Gazette. The High Court ruled on the request to cancel the regulation that requires the spouse of health personnel wishing to relocate due to spousal status to be employed as permanent staff in another public institution.
The regulation, examined upon the application of the Hakkâri 2nd Administrative Court, covers contract-based health personnel serving under Article 45/A of Decree-Law No. 663. The Constitutional Court ruled for the continuation of the current practice at its meeting on June 25, 2026. While the request for cancellation regarding the requirement for the spouse to be permanent staff when the spouse works in a contract-based status in another public institution was rejected, three members cast dissenting votes in the decision.
