Federal appeals court pauses Minnesota's AI "nudification" ban

A federal appeals court in the U.S. ruled in favor of Elon Musk's artificial intelligence company xAI, suspending the enforcement of Minnesota's state ban on AI-generated nudification images throughout the appeals process.

Appeals Court Decision

The U.S. 8th Circuit Court of Appeals issued a preliminary injunction at the request of xAI, halting the enforcement of the law.

It was reported that the brief, one-sentence order issued by the court did not provide any reasoning.

Reaction from State Officials

In a statement released by the Attorney General's office on Sunday, disappointment with the court's decision was expressed, and opposition to the ruling was emphasized.

The statement noted that the law bans sexually explicit AI products that cause the worst forms of harm to individuals and stated that it will continue to be defended.

Scope and Legislative Process of the Law

The law holds the distinction of being the first regulation aimed at preventing the conversion of real people's photographs into pornographic or sexually explicit images using artificial intelligence.

Signed into law by Governor Tim Walz in May, the bill had been passed unanimously in the state senate and by nearly all votes in the house of representatives.

The Company's Legal Challenge

Elon Musk's company xAI filed a lawsuit three days before the law went into effect, arguing that the regulation violated the First Amendment.

The company claimed that the relevant law imposed an overly broad ban on freedom of expression and visual expression tools.
