In the prosecutor's office letter, it was stated that four separate investigations are being conducted comprehensively upon notices and determinations that manipulative actions evaluated to be carried out on stocks traded in the Borsa İstanbul Equity Market were performed through portfolio management companies and investment funds.

Funds and Stocks Examined Together

It was noted that in the investigations, stocks traded on Borsa İstanbul and funds open and closed to TEFAS are examined together, and the connected and simultaneous movements between the funds and stocks are being investigated.

Crime Qualifications

The prosecutor's office announced that the actions in the files are evaluated within the scope of the crimes of qualified fraud, establishing an organization for the purpose of committing crimes, laundering asset values derived from crime, and market manipulation.

Legal Responsibilities of the CMB

In the prosecutor's office letter, it was emphasized that the CMB is obliged to carry out audit and inspection activities on investment funds in a multi-layered manner through financial and digital surveillance mechanisms.

It was stated that the request for permission from the Ministry of Treasury and Finance was made in accordance with Article 133 of the Capital Markets Law No. 6362, and the permission of the relevant Minister is required.
