Law on National Solidarity and Social Integration Adopted in the Turkish Grand National Assembly
With the new bill adopted in the General Assembly of the Parliament, the terror-free Turkey process has officially begun, and the new structures to be established and steps to be implemented have been clarified.
The Bill on Strengthening National Solidarity and Social Integration was enacted in the General Assembly of the Turkish Grand National Assembly with 467 affirmative votes. It was decided to establish two separate committees for the progress of the process, to grant a 6-month period, and to apply sentence deferrals and a political ban for certain crimes.
Parliamentary Adoption Process
The Bill on Strengthening National Solidarity and Social Integration was enacted after being adopted in the General Assembly of the Turkish Grand National Assembly with 467 votes in favor, 87 against, and 7 abstentions.
Preconditions of the Law
For the law to be implemented, security institutions must determine that the existence of the organization has been terminated and all its weapons have been surrendered. In addition, the decision of the National Security Council regarding the dissolution is required to be published in the Official Gazette.
New Structures to be Established
Within the scope of the regulation, two important committees will be formed. One of them will consist of ministers and bureaucrats headed by Vice President Cevdet Yılmaz, and the other will include representatives of political parties within the Parliament.
Process and Time Limit
A 6-month period will be granted to interested parties to benefit from the regulation, starting from the publication of the National Security Council's decision regarding the dissolution in the Official Gazette.
Scope and Restrictions
While the regulation covers various crimes related to the PKK/KCK; a sentence deferral of 10 years for sentences exceeding 15 years and 5 years for others will be introduced. A political ban of 2 to 3 years will be applied to those who benefit.
Exceptions and Exemptions
Intentional homicide crimes and severe crimes committed before 2005 were kept out of the scope. Abdullah Öcalan will not be able to benefit from these provisions, and public officials acting within the framework of the law will be exempt from criminal liability.
