Complication Insurance Becomes Mandatory Again in Health Tourism
With the Council of State Administrative Litigation Chambers accepting the appeal, the insurance obligation for surgical procedures performed in operating room conditions in international health tourism has returned.
The obligation to obtain complication insurance for surgical and interventional procedures to be performed in an operating room environment within the scope of international health tourism activities has come back into force.
Council of State Decision and Return of the Obligation
The enforcement of the complication insurance obligation stipulated in the Regulation on International Health Tourism and Tourist Health had been previously suspended.
As a result of the appeal filed by the Ministry of Health, the Council of State Administrative Litigation Chambers revoked the previous decision to stay of execution.
Implementation Principles and Administrative Sanctions
With this decision, complication insurance has become mandatory for surgical and interventional procedures to be performed in an operating room environment.
In case of non-compliance with this obligation, various administrative sanctions set forth in the third row of Appendix-4 form of the relevant Regulation may be applied.

It is crucially reminded that colleagues should obtain the necessary insurance while continuing their activities in order to avoid facing any administrative sanctions.
On the other hand, it was also reported that the judicial process regarding the merits of the lawsuit is still ongoing.
Difference Between Malpractice and Complication Insurance
While malpractice insurance covers the physician's application error and fault, complication insurance offers a different guarantee.
Complication insurance covers unexpected reactions developing due to the patient's physical constitution or medical processes without the physician's fault, as well as revision costs.
