Legal Action by Genel Sağlık-İş Against Dentistry Specialty Decision

Genel Sağlık-İş has filed a lawsuit in the 8th Chamber of the Council of State demanding the annulment and stay of execution of the Medical Specialty Board's decision, stating that it contradicts the purpose and essence of specialty training in dentistry.

Genel Sağlık-İş announced that it has taken the Medical Specialty Board's decision to court on the grounds that it violates the purpose and essence of specialty training in dentistry.

Difference Between Education Types

While PhD education aims to produce academic knowledge, specialty training in dentistry is a special professional education aimed at providing clinical competence and practical skills.

It was stated that the Ministry of Health and the Medical Specialty Board did not take this sharp distinction into account and attempted to introduce an unlawful system.

Allegation of Exceeding Legal Authority

It was emphasized that the relevant article of Law No. 1219 does not grant the Medical Specialty Board the authority to create a new method of acquiring a specialty certificate that is not provided for in the law.

It was stated that the Board exceeded its legal authority and created a new specialty acquisition model.

Principle of Equality and Contradiction

It was noted that allowing individuals who have gone through different regimes to acquire the same title could create situations contrary to the principle of equality and lead to labor exploitation.

It was stated that there is a major contradiction between the Board's past decisions and its current practices.
