Ombudsman İlkan Varol on the Ministry of Health's Decision Regarding Surgery Expenses
High Administrative Ombudsman İlkan Varol ruled that there was no administrative error or negligence in the Ministry of Health's refusal to cover the retina tear surgery expenses of a citizen.
High Administrative Ombudsman İlkan Varol examined the application regarding the refusal of the Ministry of Health to cover the treatment expenses of Orhan Kabataş, who underwent surgery for a retina tear in Turkey. As a result of the examination, it was announced that the Ministry did not act contrary to the legislation and that there was no administrative error.
Application Process and Grounds
Orhan Kabataş had to undergo retina tear surgery in Turkey, stating that it could not be performed in the TRNC, and applied to the Ministry of Health for the coverage of the expenses. Upon the rejection of the request, the application was brought to the Ombudsman's Office.
Evaluation of the Ministry of Health
The Ministry of Health found the request inappropriate, stating that the patient went abroad on his own accord without a board referral and that the surgery performed was of a nature that could be carried out within the relevant clinic.
Legislation and Ombudsman Decision
Ombudsman İlkan Varol emphasized that, in accordance with the Health Boards Regulation, it is not possible to cover expenses incurred without a Central Health Board report, and concluded that there was no administrative error or negligence on the part of the Ministry.
