New Circular Initiating a New Era in Radio Frequency Inspection Published
A new circular issued by the Minister of Science and Technology introduces remote methods for radio frequency inspections while granting exemptions to those who comply with the rules.
The Ministry of Science and Technology has officially announced new Circular No. 44/2026/TT-BKHCN regulating the inspection of radio frequencies. Renewed after a decade, the legislation introduces significant innovations in line with digital transformation requirements, such as remote inspections and on-site inspection exemptions for compliant businesses.
Effective Date and Scope of the Circular
Signed and issued by the Minister of Science and Technology, Circular No. 44/2026/TT-BKHCN will enter into force on September 15, 2026. This new regulation will replace the previously applicable old circular numbered 02/2016/TT-BTTTT.
Digital Transformation and Renewal of Inspection Methods
Prepared in consideration of the rapid development in telecommunications infrastructure and radio equipment after a decade of implementation, the regulation meets the requirements of digital transformation in state management.
The new text reorganizes radio frequency inspection processes with the principles of flexibility, proactivity, and the more intensive use of information technology.
Remote Inspection and Use of Information Technology
Among the innovations introduced by the circular, the remote inspection method carried out through information technology applications stands out.
Competent authorities will be able to conduct assessments independently of the workplace through electronic records, documents, and data.
Inspection Exemption for Compliant Businesses
On-site inspection exemptions are provided for qualifying businesses, household businesses, and individual enterprises that meet specific criteria.
To qualify for the exemption, it is required to have been inspected at least once within the three years prior to the assessment and to have committed no violations.
Clarification of Duties and Powers of Institutions
The new circular clarifies the powers and responsibilities of the Radio Frequency Department, the Department of Science and Technology, and the Regional Radio Frequency Center, which will participate in the inspection process.
