As a result of the Council of State's annulment decisions regarding restrictions on the right of withdrawal within the scope of the Ministry of Trade's Regulation on Distance Contracts, return shipping fees will not be collected from consumers for electronic products such as smartphones, computers, tablets, and smartwatches.

Restrictions on the right of withdrawal applied to certain products under the Regulation on Distance Contracts prepared by the Ministry of Trade were taken to court. Following the annulment decisions rendered by the Council of State, the provisions in question lost their validity, and a step was taken towards protecting consumers' rights in distance sales.

Right of Return for Electronic Products

While electronic products such as smartphones, computers, tablets, and smartwatches particularly stood out in the regulation, motorcycle sales were also among the product groups included within the scope of the regulation regarding the right of withdrawal.

No Shipping Fees Will Be Charged

The prominent aspect of the amendment for consumers has been the return shipping fees. If the right of withdrawal is exercised in accordance with the legislation, collecting the shipping cost incurred for returning the product to the seller from the consumer has been abandoned.

In distance sales, consumers can benefit from the right of withdrawal within the legal period without showing any justification and without paying any penal clause, provided that the exceptions specified in the legislation are reserved. Various exceptions exist in the legislation depending on the nature of the product and the sales conditions.
