Two New Laws on Artificial Intelligence Transparency Take Effect in California
The SB 53 and TDTA laws regulating AI safety and data transparency in the state of California went into effect on January 1, 2026.
Signed by California Governor Gavin Newsom and taking effect on January 1, 2026, the SB 53 and TDTA laws form the foundation of the state's approach to overseeing artificial intelligence technologies. The laws aim to comprehensively subject frontier AI models and the data used to train them to transparency rules.
Senate Bill 53 (SB 53) and the Generative Artificial Intelligence Training Data Transparency Act (TDTA), which sit at the center of AI regulations in California, took effect on January 1, 2026. While SB 53 examines models for potential risks, TDTA focuses on the origin of the data used to create the models, offering a complementary structure between the two laws.
While SB 53 covers only major frontier developers exceeding compute thresholds and $500 million in annual gross revenue, TDTA targets a much broader range of developers who design, code, or substantially modify AI systems intended for public use.
