Details of the Application and Allegations
Orhan Kabataş stated that he had to undergo retinal detachment surgery in Turkey, which he stated could not be performed in the TRNC, and applied to the Ministry of Health for his expenses to be covered.
Upon the rejection of his request, Kabataş applied to the Ombudsman, arguing that he faced discrimination as the expenses of individuals in similar situations were covered.
Treatment Process and Approach of the Ministry
Kabataş went to Turkey through private clinics on August 20, 2025, due to his eye condition, and requested that his expenses be covered after being operated on the next day.
The Ministry of Health determined that the patient went abroad on his own initiative without a medical board referral and that the surgery could be performed within the clinic's own structure.
Legislation and Ombudsman Decision
It was recalled that pursuant to Article 14 of the Health Boards Regulation, referral procedures can be carried out with a Central Health Board report.
Ombudsman İlkan Varol emphasized that it is legally impossible to cover expenses incurred without obtaining a board report and that the decisions of the Appeal Board are final.
